毛里求斯关于被拘押外籍人士亲友探监的相关规定

  近期,毛里求斯外交部照会各驻毛使团,通告关于在毛被拘押外籍人士亲友探监的相关规定,主要内容如下:  

  一、被拘押外籍人士的亲友,需要至少提前3周向本国驻毛里求斯使馆提交探视申请并同时提交亲友关系证明、身份证明和诚信证明。被拘押外籍人士亲友不能直接向毛外交部提交探视申请。  

  二、使馆将探视申请和有关文件转交毛里求斯外交部,由外交部转交总理府/监狱总监,由监狱总监转交警察总监审批。  

  三、警察总监出具审批意见后,监狱总监将审批意见及相关材料报送总理府审批。总理府审批结果将分别送外交部和监狱总监,由外交部通知使馆,由使馆通知被拘押人士亲友。  

  四、被拘押外籍人士亲友到监狱探视时,需出示身份证明,并接受安全检查。探视人员不得携带录像、录音设备,其他个人物品,如手机、照相机、手表、眼镜、太阳镜、钢笔、首饰等,也需交监狱方暂存。探视全程将在一位监狱官的陪同下进行。

  GUIDELINES FOR VISITS TO FOREIGN DETAINEES BY THEIR NATIONALS/RELATIVES/FRIENDS  

     

  1.    Relatives/friends of foreign detainees presently undergoing sentence in the Mauritian prisons, who intend to visit the detainees have to write to their respective Embassy/High Commission/Non Resident Diplomatic Missions accredited to Mauritius, notifying their intention and the probable date of such visit.  

  2.    The request should be submitted to the Embassy/High Commission/Non Resident Diplomatic Missions at least three weeks before the proposed date of the visit so as to allow sufficient time for processing the request.  

  3.    The person has to submit proof of relationship, Testimonials and proof of identity of the visitors together with security clearance as to the bona fide of the applicant should also be produced.  

  4.    The relative Embassy/High Commission/Non Resident Diplomatic Missions would channel the request together with supporting documents to the Secretary for Foreign Affairs who in turn would transit the request to the Prime Minister’s Office/Commissioner of Prisons.  

  5.    The Commissioner of Prisons on receiving the request would forward it to the Commissioner of Police of clearance.  

  6.    Upon clearance from the Police, the Commission of Prisons would communicate his stand regarding the visit together with all reports and documents to the Prime Minister’s Office.  

  7.    Finally, the Prime Minister’s Office would, on the basis of documents/reports submitted by the Commissioner of Prisons and Commissioner of Police, convey its decision to the Secretary for Foreign Affairs and Commissioner of Prisons.  

  8.    The Secretary of Foreign Affairs would then intimate the Embassy/High Commission.  

  Note (¡) Visitors/Relatives of detainees applying directly to the Ministry of Foreign Affairs shall be required to adhere to the guidelines.  

  (¡¡)Guidelines 1-3 shall not apply to visit by Consular Officers/Members of the diplomatic mission.  

  (¡¡¡)Visits to detainees shall be governed by standing order No.47 of the Mauritius Prison Service, which inter alia providers for one visit per week for detainees on remand, and one fortnightly visit for convicted detainees undergoing sentence.  

  (¡¡¡¡)Embassy/High Commission/Non Resident Diplomatic Missions accredited to Mauritius are requested to inform visitors/relatives that they should ensure that approval has been obtained before booking their air tickets for Mauritius.  

  CONTROL AT THE ACCESS GATE  

  9.    At the Main Entrance of the Prison, the Relative/Friends of foreign detainee will be requested to show proof of identity which will be counterchecked by a Prison Officer no below the rank of Assistant Superintendent of Prisons.  

  10. The visitors will be searched and not allowed to enter the waiting room if found in possession of any object/gadget that may capture images and sound. He/She will be required to leave behind his/her personal belongings and other articles including mobile phones, cameras, watches, spectacles, sun glasses, pens, jewellery, etc in his/her possession for security and safety reasons.  

  11. Hand held metal detectors may be used to detect prohibited articles.  

  12. Any visit other than professional (e,g visit by barristers) should take place within the view and hearing of a Prison Officer.  

  13. The Main Entrance, Waiting Room and Control Room will be closely monitored by the Officers-in-charge during such visit.
